1. Acceptance of Terms
Welcome to UKWorkConnect ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the UKWorkConnect website (ukworkconnect.com), mobile applications, and all associated services provided by us (collectively, the "Services"). By accessing or using our Services, whether as a guest, a registered Job Seeker, or an Employer, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.
2. Eligibility
To use our Services, you must be at least 18 years of age and possess the legal authority to form a legally binding contract. If you are using the Services on behalf of a company or organization (e.g., as an Employer), you represent and warrant that you have the authority to bind that entity to these Terms. By using the Services, Job Seekers represent that they have the legal right to work in Australia or are actively seeking lawful sponsorship.
3. User Accounts and Security
To access certain features of the platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account. You must immediately notify WorklyJobs of any unauthorized use of your account or any other breach of security.
4. Terms for Job Seekers
If you are a Job Seeker using UKWorkConnect to find employment, you agree to the following:
- Accuracy of Information: All information you provide in your profile, resume, and job applications must be truthful, accurate, and not misleading.
- No Guarantee of Employment: UKWorkConnect does not guarantee that you will receive any job offers, interviews, or employment by using our Services. We are not an employment agency, and we do not act as an agent for any Employer.
- Assumption of Risk: You are solely responsible for evaluating the suitability of any Employer, job listing, or employment offer. We do not perform background checks on Employers and cannot guarantee the validity or safety of any listed opportunity.
5. Terms for Employers and Recruiters
If you are an Employer, recruiter, or agency posting job advertisements or searching for candidates, you agree to the following:
- Compliance with Laws: All job postings must comply with applicable Australian laws, including but not limited to the Fair Work Act 2009, anti-discrimination laws, and equal employment opportunity regulations. You must not post advertisements that discriminate on the basis of race, gender, age, religion, sexual orientation, or disability.
- Prohibited Listings: You may not post multi-level marketing (MLM) opportunities, pyramid schemes, jobs requiring upfront payments from candidates, or illegal/adult industry positions.
- Use of Candidate Data: You may only use candidate profiles, resumes, and contact information for the sole purpose of evaluating them for actual job openings. You may not sell, distribute, or use candidate data for unrelated marketing purposes.
6. Acceptable Use and Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Services for any illegal purpose or in violation of any local, state, national, or international law.
- Scraping, crawling, or using automated means (such as bots or spiders) to access, collect, or extract data from UKWorkConnect without our express written permission.
- Interfering with or disrupting the security, integrity, or performance of the Services.
- Posting content that is defamatory, offensive, harassing, threatening, or otherwise objectionable.
- Uploading viruses, malware, or other malicious code.
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
7. Intellectual Property Rights
Our Content: The Services, including all text, graphics, logos, website design, and software, are the property of WorklyJobs or its licensors and are protected by Australian and international copyright and trademark laws. You may not copy, reproduce, or modify any part of our Services without our prior written consent.
Your Content: By posting any content (such as a resume, company profile, or job listing) on UKWorkConnect, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute such content in connection with providing and operating the Services.
8. Third-Party Links and Services
Our platform may contain links to third-party websites, applications, or services that are not owned or controlled by WorklyJobs. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You access any such third-party links at your own risk.
9. Disclaimers and Warranties
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKLYJOBS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.
10. Limitation of Liability
Nothing in these Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (ACL), which by law may not be limited or excluded. Subject to this, to the maximum extent permitted by law, UKWorkConnect and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Services, whether based on contract, tort, strict liability, or otherwise.
11. Indemnification
You agree to indemnify, defend, and hold harmless UKWorkConnect, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your violation of these Terms or your use or misuse of the Services.
12. Termination
We reserve the right, in our sole discretion, to suspend or terminate your account and your access to the Services at any time, for any reason, without notice or liability, including if we believe you have violated these Terms. Upon termination, all provisions of these Terms which by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law and Jurisdiction
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of New South Wales (NSW), Australia, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Sydney, New South Wales, and you hereby consent to the personal jurisdiction and venue therein.
14. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
